Legal Advisor: Mandated Reporting

The following case study and article provides a brief summary of Massachusetts mandated reporting law. Physicians in Massachusetts are required to report the suspected abuse of vulnerable populations such as children, the elderly, and the disabled. Physicians must make a report whenever they have reasonable cause to believe that physical, sexual or any other types of abuse is occurring or has occurred, or when there is evidence of neglect or an imminent risk of serious harm to a member of these vulnerable populations.

The Legal Advisor publication is issued quarterly by the Massachusetts Medical Society and Adler, Cohen, Harvey, Wakeman & Guekguezian, LLP, as an information source. Nothing herein should be construed as legal advice or legal opinions regarding specific situations. Legal counsel should be consulted for application of law and regulations in each individual case before any action is taken or any decision is made.
