Program Overview
The federal No Surprises Act and the Commonwealth’s surprise billing law (Chapter 260 of the Acts of 2020) are both effective January 1, 2022. While both laws protect consumers from receiving surprise bills, the laws achieve those goals in somewhat different
ways. Requirements around notice and disclosure, consent, determination of payment for out-of-network services, and penalties for non-compliance vary based on the provisions in each law. The ways in which these laws intersect will be critical for
understanding what providers must do to be in compliance and for consumers to receive relevant information.
